Terms & Conditions
Meander Valley Council is building a library of photos, videos, and other creative works that can be used by Council and others in various ways to promote Meander Valley as a place. By submitting a photo to the Community Camera Lens photography competition, you are contributing your photo to this library in accordance with the terms and conditions below.
1. Copyright Ownership
The Creator retains copyright in the Works. Nothing in this agreement constitutes an assignment of copyright.
2. Licence to Host and Distribute
The Creator grants Meander Valley Council a non-exclusive, worldwide, irrevocable, royalty-free licence to:
(a) copy, store, and reproduce the Works;
(b) upload and make the Works publicly available (including on websites, social media, or digital archives); and,
(c) license the Works to the public under the Creative Commons Licence CC BY 4.0 on the Creator’s behalf.
3. Creator’s Consent to Creative Commons Licence Terms
The Creator acknowledges and agrees that:
(a) the Works will be made available to the public under the Creative Commons Licence CC BY 4.0;
(b) members of the public may exercise the rights granted by that licence, including (if applicable) creating adaptations or derivative works; and,
(c) the Creator will not revoke or withdraw their agreement to apply the licence to the Works.
4. Moral Rights
The Creator consents to:
(a) any acts or omissions in connection with the Works that would otherwise infringe their moral rights under the Copyright Act 1968 (Cth), to the extent necessary for the operation of the Creative Commons Licence CC BY 4.0; and,
(b) the following attribution style: “Photo by [the name you submitted with this photo]”
5. Warranties & Indemnity
(a) The Creator warrants that: they are the sole creator of the Works and hold the necessary copyright; and, the Works do not infringe the rights (including copyright) of any third party.
(b) The Creator indemnifies Meander Valley Council against any claim arising from breach of the warranties at (a).
6. Governing Law
This agreement is governed by the laws of Tasmania, Australia.
